Data show that the network game of this emerging industry booming, which contains a huge economic potential. In the case of Korea, the game industry gradually become the backbone industry in this country. However, in our country, because of the lack of legal recognition and protection, the network game virtual property disputes increased day by day. Although there is no current legal theory on the formation of the legal nature of virtual property in the network games are inconclusive, but the virtual property of network game and virtual property rights based on the parties to receive legal protection is beyond doubt. The right without the protection of the law is a mere scrap of paper, only through the law prohibited and sanctions for violations, we can ensure the proper exercise of rights. If the network game virtual property protection is not fair, not only the game player will against the legitimate property rights, but also the network game service providers, and at the same time it will weakened the development of the game industry, eventually restrict the development of national economy. Therefore, the civil law protection of virtual property in the network games is the legal issues worthy to study.The main problems of China’s online game virtual property is the legal attribute is unknown, which lead to a lack of adequate legal protection. This article take this as the breakthrough point, firstly analyzes the concept and characteristics of virtual property in network games, then make understand about the nature of the virtual property of network games, the nature of virtual property in the network games, and the paper cited the most scholars advocate of online game virtual property of different properties, at the same time the author analyzes all kinds of views, the author combined with the characteristic of network virtual property itself, the network game virtual property should belong to the property. Then, this paper make analysis of China’s current situation of protection of network virtual property. Through the analysis of two aspects of the legislation and the judicial practice, summed up the current problems in the field. The last part of the article, the author put forward some improvement measures to protect virtual property of network games.
