Research On The Construction Of CEPA Dispute Settlement Mechanism

The integration of external environment for economic development, accelerate the internal strong demand for economic and trade exchanges are not obstacles, the central government is considering the development of trade integration system- an innovative attempt in our internal CEPA. CEPA is the basic document Chinese mainland and the Macao Special Administrative Region, the Hongkong economic and trade integration development. Put forward the innovative mode of profound consideration to the Hongkong and Macao Special Administrative Region as a separate customs territory in WTO in the development of foreign trade and economic advantages, and to undertake the transfer of Hong Kong and Macao mainland Chinese in professional, driven by its own economic structure optimization effect. At the same time, considering the political, the implementation of CEPA can provide a more broad market for Hong Kong and Macao, Hongkong and Macao to maintain long-term prosperity and stability.Since 2003, the central government and Hongkong, Macao Special Administrative Region Government signed economic and trade integration in the development of CEPA, which has gone through 13 years, economic and trade data is gratifying, the degree of liberalization significantly improved. But there are some problems are also worth noting, for example, the mainland market opening degree is lower than the actual text of the opening degree of the Ministry of Commerce estimates of economic freedom, there is still much room for improvement; to Hong Kong and Macao investors, invisible trade barriers, government policy restrictions still exist; the loss of communication channels of the mainland and Hong Kong and Macao exist; the legal system, the business environment, industry differences in the rules for disputes, friction and frequent hidden danger. The need to introduce a sound dispute settlement mechanism, in order to protect the development of the three economic and trade liberalization. In view of there is no corresponding measures, the author will look to the regional integration of the world developed area, especially the European Union and the North American Free Trade Area, in order to seek for the dispute settlement mechanism under the framework of CEPA is established to provide experience.
