Under the economy market, food safety crimes are showing a intensi fied trend, bringing huge social impact, seriously endanger to the public’s health and property safety. Under the situation, criminal legislation was carried out heavier penalties under the guidance of severely punished criminal policy. However, frequently occurrence of food safety crimes reflect the regulation of food safety criminal still has some problems. The criminal legislation are careless, mainly legal interests defined error, system arrangement unscientific. Food safety policy guidance criminal justice, although to some extent, facilitate the judicial practice, but also because of its "utilitarian" created some new problems.The criminal policy of simplification severely punish can not fit the crime ’s characteristics, and it is difficult to form a continuous crime deterrent under food safety characteristics of the existing food safety. In order to fully and effectively punish food safety crimes, and create a safe eating environment, the criminal policy of food safety should change from "severe but loose" to "serious but not severe". Food safety crime policy ought mainly "Strict" and "with Leniency" supplemented. In criminal legislation, we should tight network of criminal law, redefining the major food safety crimes’ legal benefits, food safety crimes should categorize as a crime of endangering public safety. In criminal justice, criminal policy should go utilitarian, adhere to the principle of legality, accurate applicable criminal charges in order to declare the action of criminal regulation,p ut end to the phenomenon that crime but did not get punished, and use administrative punishment instead of criminal penalties.
