From the birth of the computer program to its independently developing, and deeply to the 21st century, the computer program has gone through more than half a century exactly. It had changed human life and production thoroughly. Over time, I firmly believe that computer program will finally develop to the direction of its modular engineering, complexity and intelligent farther. It likes a magic wand, changing magically and impacting all aspects of human profoundly. Unfortunately, piracy launched the program from its birth likes a plague in general, displaying its death spiral all the time, which restricted the development of China’s software industry seriously and the situation of computer program protection is getting worse.The piracy of computer program is an old proposition but there is no solution in legislative and judicial level. Another aspect, it is also a new proposition because of the existences of different piracies all around countries. Based on the above, the reasons of selecting governance processes piracy as my postgraduate thesis is not only awaking its old but also its new-acclimatized legislative mode programs are not conducive to the program copyright protections. This is why the computer program piracy is still remaining highly. Although there are all kind of research about the unreasonable legal system is one of the important causes of piracy, but failed to examine and grasp from macro on a higher point. Base on this opportunity, through sorting, analyzing, and summarizing the ins and Outs of the computer program copyright legislation mode of developed countries particular USA, EU, and Japan, the reach tries to find a feasible single-line model legislation which conforms China’s computer program industry development and the public interest, and outlook the future of Program patentability emphatically. Of course, piracy has becalmed a worldwide problem and the reasons behind it are complex, such as legal, economy and sociology reason. This paper, as a legal research on piracy Governance, Legal strategies and measures to improve the governance of our program piracy from the five legal loopholes conflicted by the )rograms instrumental and copyright protection by focusing on the basis of the existing protected mode.
