Genetically Modified Foods are new products of the development of science and technology, its appearance has played a positive role in reducing costs,promoting grain production and so on. In view of the damage caused by the potential risks of Genetically Modified Foods has not been scientifically proved, the safety dispute is also continued with the development process of Genetically Modified Foods. So, how to regulate Genetically Modified Foods and protect the safety become the key issue that every country explores actively.Thus, the “loose and tolerance”mode represented by the United States,the“strict and cautious”mode represented by the European Union and the compromised mode in Japan are derived. In fact, the exploration of the legal regulation mode of Genetically Modified Foods in each country is based on every country’s situation and the comprehensive considerations of their interests.Our country is not only the importing country of the Genetically Modified Foods, but also the relative underdeveloped country of transgenic technology. So Chinese legal regulation of Genetically Modified Foods should not be like either the United States’ mode or the European Union’s mode. We need to follow the fact of Chinese Genetically Modified Foods’ development, persist in Chinese characteristics and say no to “ISM”. Then we explore the new path of Chinese legal regulation of Genetically Modified Foods fitted for their development and safety.Based on the above consideration, we start from the basic concept and the Classification of Genetically Modified Foods, analyze the current situation and deficiency during the process of Chinese legal regulation of Genetically Modified Foods. Then, based on the comparison and study of the foreign experience, around the legislation, supervision, information disclosure and legal liability, we make positive suggestions on the way of improving Chinese legal regulation of Genetically Modified Foods.
