Research On Evaluation System Of The Government Ruled By Law

The government ruled by law, not only uses the law to control government, also means that the government governs the society by law.It is a form of governance in the government today,is also the practice or goals that the governments in the world are pursuing.From 1992, the 14th National Congress of the party put the rule of law in a prominent position,to 2012,the 18th Congress put forward the goal of completing basically construction of government ruled by law to 2020 in China,During this period the government construction under the rule of law in our country has been a lack of clear specific framework,there is only defined objectives,principles,local or surface orientation,particularly lack of operation. Since eight years after the framework of the market economy was stipulated in the Decision of Some problems about the establishment of the socialist market economy system in 1993,the basic market economic system has been established.As everyone knows, GDP is introduced into the economic field, that promotes the rapid development of economy.And the development of rule of law in China is relatively slow.The rule of law and economic development process of China, shows that the idea of GDP and the government performance evaluation theory into the field of the rule of law,to build the quantitative,concrete and feasible evaluation system, to promote our country government by law construction is very necessary.The construction of the rule of law government for examination and assessment system,helps to check the current situation of the construction of the rule of law government.The comparison and analysis of legal status is conducive to find out the existing problems and oversight in the law construction of the modern government, and improve the legal system of government.With the help of the evaluation results,we can also see that the construction situation and process of the government ruled by law,so as to predict the future development trend of the government ruled by law, and guide local efforts to achieve the goal of law government.In practice it has proved that the country is expected to become a true "rule of law" when the rule of law construction is from the "quality" to the "quantity".This paper uses some methods such as the empirical,comparison, the value and the system analysis synthetically,and has a general understanding for the collection of made in China for examination and assessment of the government under the rule of law,then compares the extraterritorial legal government appraisal, summarizes up the experience of government performance evaluation system.On the basis of the overall grasp of the government under the rule of law in the evaluation,with the combination and consideration of theory and practice,I elaborated systematically the related content about our government construction by law evaluation system.Finally, in the operation, according to the different value emphasis,I set up the weights of all elements of the evaluation system.The contents of this paper consist of five parts,they are respectively basic theories on evaluation system of the government ruled by law,local practice of evaluation system of the government ruled by law in China,extraterritorial investigation of evaluation system of the government ruled by law,construction of evaluation system of the government ruled by law in China,application of evaluation system of the government ruled by law in China. It mainly elaborates the meaning, characteristics, necessity and the three theories such as national governance, the rule of law government and performance evaluation of the legal government evaluation system in the basic theory part.It introduces the present situation of the construction of local government appraisal system at first, and then analyzes the shortcomings and the reasons for its existence in the part of the local practice in China.It summarizes the experience of the evaluation system construction that our government can learn,on the basis of analyzing the rule of law of extraterritorial government performance evaluation status in the part of extraterritorial investigation.In evaluation system construction part,I discuss the guiding ideology,construction principle of construction, and then puts forward the basic framework of system construction,which is divided into two modules of internal assessment and external assessment,referring to the appraisal object,subject,elements and system structure.Then the paper analyzes the evaluation factors,including 10 factors of the internal examination and 9 factors of external supervision assessment,and the main basis of system construction.Finally,from eight aspects such as the evaluation subjects, method,way,standard,procedure,weight,evaluation result feedback and application,the paper illuminates the basic operation part of evaluation system.In this paper, the innovation is mainly the structure constructed scientifically and the content of legal interpretation in evaluation system of the government ruled by law.The paper introduces the supervision and evaluation part,broadens the evaluation subject,evaluates the government ruled by law from two dimensions of the internal examination and external assessment,in order to ensure the result is more comprehensive and objective,and the two coexist with a certain weight in the structure.In addition to the public and experts, evaluation subject should also include the Party committee,NPC, CPPCC,The people’s Courts and Procuratorate,Audit and Supervision organs at the same level.In the content,The paper strengthens the basic position of the core elements and the main basis of evaluation system construction in the appraisal system, so as to make the construction of evaluation system more prominent in its scientific nature, rationality,and normative aspects.
