Survey Report Of Legal Protection Of Famous Historic Commercial Names In Shanxi

Famous historic commercial names is a historic witness of both the native traditional culture and the characteristics of times.It is an important cultural resources.With highly visibility and great reputation, the value of intangible assets can not be valued. The famous historic commercial names are faced with legal problems currently since the development of economy.Thus,the issue of legal protection of famous historic commercial names has become an important topic.With a long history lasted, Shanxi gives birth to lots of famous historic commercial names.Over one hundred famous historic commercial names with more than seventy years history exist in Shanxi.Famous historic commercial names disappeared or faced with bankruptcy as time flies.Old cultures rooted in these famous historic commercial names also disappear gradually with the decline of the famous historic commercial names,only a few of them developed on the original basis.Investigation the issue of legal protection on famous historic commercial names has significant value for protection of famous historic commercial names.The author began to conduct research on the legal protection of famous historic commercial names in Shanxi on October2014.Based on analysis of the documents and data,and combined with the laws on famous historic commercial names of Shanxi legal protection and presentation situation as well, the author carried discussion on the vary issue, identified problems, and proposed solutions.This paper mainly includes four parts.The first part introduces the surveys constitution of famous historic commercial names in Shanxi. It introduced the legal protection present situation of famous historic commercial names in Shanxi, and the survey investigation steps and content. The second part is a describe of the result of the survey on legal protection of famous historic commercial names in Shanxi. According to the results of the survey, this study expounded and summarized the present situation of famous historic commercial names,consumers cognition on it,and the national legislation,local governments,or enterprises themselves protective action.The third part discusses problems existed in the protection of intellectual property rights of time-honored brands.According to the national laws and regulationS,the author analyzed the protection situation of government and enterprises to point out the problem.In the last part,the author analyzed and summarized the problems,proposed own suggestions and countermeasures from three aspects of the national legislation,local governments and enterprises.
