Moral And Legal Analysis And Solution Study In The "Rashomon-style" Helping Issue

As is known to all, <Rashomon> is a Japanese classic movie. In this paper, the “Roshomon-style” helping events refer to the cases of disputes caused by helping people. Whether it is courageous or tort, doing good or being blackmailed? Because of the lack of solid evidence, each party sticking to their perspectives respectively, it is difficult to clarify the reality of the events of this kind, which finally influences the opinions of the commons and the judiciary decisions. The Peng Yu Case in Nanjing is typical among such issues. On the basis of a large amount of literature, the author makes a deep analysis and thinking on the “Rashomon-style” cases. In this paper, the author tries to find an effective way to solve the “Rashomon-style” cases by analyzing the relationship and the interactive theory between social morality and legal issues which highlight in such kind of cases, so that people can both dare to and be willing to help. Only in this way can we give play to the positive energy and regain confidence in both the social trust and the harmonious development.Based on the above train of thought, the paper explains mainly from the following three aspects. Firstly, by analyzing the implication of the “Rashomon-style” helping events, explaining the definition and the relationship of morality and law, the paper elaborates the general principles of interaction between morality and law. Secondly, through the analysis of the relationship between morality and law reflected in the “Rashomon-style” helping issues, the paper finds out many reasons from different points hiding behind the realities, such as reasons of economy and law, integrity and credibility, public opinion, etc. which lays the foundation of exploring the final solution. Thirdly, on the basis of the above study, the paper proposes feasible countermeasures for the “Rashomon-style” helping events from several aspects, for example, increasing the economic investment, perfecting the legal mechanism and social management, standardizing the direction of social public opinion and the news spread, improving the whole nation’s quality and so on. The paper strives to put forward the countermeasures with both theoretical basis and practical value. It tries to get rid of the dilemma——“To help or not to help” and achieve the sound development of the social atmosphere, and progress day by day.
