Research On The Criminal Control Of Network Rumors

With the continuous development of the Internet, people exercise the right to freedom of speech is more and more widely.And the way of it is becoming more various.As a fundamental right of human being, it has been more fully protected.However,the Internet is a double-edged sword. It can protect the people’s freedom of speech very well. Meanwile, the Internet rumors will increase doubly. The spread of the Internet has brought great harm to the country, the society and the individul. It is urgent to use legal means to protect the freedom of expression and the Internet. Therefore, this article is divided into three parts. It will get a further research for the Internet rumors of the criminal law control.In the first part, it not only combines domestic history with foreign history, but also combines with their research for the definition of "rumor" and "Internet rumors". It summarize the legal definition of Internet rumors and analyzes the character of it.At the same time, from criminal law angle, it will get a further research for the legitimacy of the Internet rumors’ criminal law control.The second part mainly introduces the successful experience of the mainland legal system countries, such as,Germany,South Korea and the United States of America, Sinagapore in the practice of Internet rumors control. It analyzes China’s Internet rumors in the process of criminal, law enforcement, judicial and other issues through the comparison of domestic and international legal control of the Internet rumors.The third part is on the basis of the previous discussion, combining with the characteristics of Internet rumors and current criminal law control problems, it will analyze how to improve criminal legislation, the allocation of criminal and prison sentence, the operation procedures and the procedure of the proceedings. The aim of it is to construct a set of effective Internet rumors’ control system under the framework of criminal law.
