Research On Legal Issues About The Insurance System Of Affiliated Vehicle

The Chapter 1 and Chapter 2 of the thesis are the brief introduction on the auto insurance system and the business practice of the affiliated vehicle. The Chapter 3 describes two typical insurance cases on affiliated vehicle with accident. In the following Chapters, the main issues are analyzed including the determination of legal status, the responsibilities of the parties with the affiliated vehicle, the Principle of Insurable Interest and the application of the exemption clause.Based on the cases involved to review and summarize the practical problems, the thesis put forward to determine insurance interests with the principle of Utmost Good Faith as a new perspective and suggests that the insurable interest should be with clearly interpretation in the reform of the system. The parties of the insurance contract shall abide by the principle of good faith. As the main body with the responsibilities on the contract, the insurance company should demonstrate well service manner and strengthen through the formulation of reasonable insurance clause. The thesis supports the view that establishing the relevant institutions of linkage mechanism and so on.
