Research On Leagal Policy Of "One Belt And One Road" Strategy

At present, China’s in the pursuit of peaceful development to promote economic development in the region and the world, constantly through the promotion of foreign trade and foreign investment. "One belt one road" strategic vision complies with the needs of China’s opening up for regional restructuring, but also conforms the need for industrial transformation and flow of factors of international industrial transfer, promoting China’s cooperation with other countries. "One belt one road" strategy’s carrying up is a great cause for the benefit of the people of all countries along the route, will be widely welcomed among the countries. The "one belt one road" strategy will provide the neighboring countries to be the "free rider" in the form of improving their economic development, while the Strategy is to become China’s new economic growth point. However, the implementation of the Strategy is faced with many difficulties and challenges, for example, how will our rule of law be complied with the implementation of the Strategy, how to successfully advance through legal measures? Research on Legal Policy of the "one belt one road" strategy is the topic of this article and its research purpose. Domestic scholars mostly carry the research from the trade friction, countervailing and other specific legal matters. The dispute settlement mechanism, as well as legal protection investment about the Strategy was hardly discussed. This article will explain how to set up the mechanism of implementing the Strategy from the current situation of foreign trade laws and regulations through the investigation and analysis of legal status of foreign trade legislation and problems existed. By studying the countries involving the Strategy, especially the South Asian countries, this article will give a full understanding of these countries’ comprehensive rule of law, and suggestions of establishment of "One belt one road "Trade Promotion Committee, set up of multilateral trade coordination mechanism, legal dispute settlement mechanism, and finally interprets the conflicts and coordination while implementing the Strategy from the perspective of international law.In order to successfully achieve the "one belt one road" strategy and to ensure long-term development of this strategy, we must take the road of the rule of law, which should become the consensus of China and the relevant countries.
