As China’s market economy, an aging population trends are becoming evident, re-employment of retirees has become a new form of labor and employment, which exists widely in the production of contemporary art work. However, existing labor legislation does not give a clear legal regulation of this new employment groups, especially retirement re-employment labor law How to identify the property,whether it should be part of these workers special protection and should be protected and to what extent specific theorists and practice there has been a big difference. Some scholars believe that the re-employment of retired labor relations should be defined as labor relations, while others believe it should be recognized as labor relations. In this paper, starting from the case, extract the practice of the employer and the retirement re-employment and labor relations disputes related injuries dispute specific analysis, in order to clear re-employment of retired personnel qualified workers labor law, with the employer may be formed between the point of view of labor relations. In the clear legal labor relations on the basis of attributes further define retirement re-employment because of work-related injuries can be identified as work-related injuries, and pointed out the difficulties of legislation and practice related injuries defect exists in operation, the relevant legislative proposals related injuries and insurance recommendation rate adjustment.
