Slowly scrolling of history, the time freezes a frame of the Opium War which was disheartening.Full of eyes was the devastating all over China. Opium was a unit of turbid currents, raging through every corner. The former tobacco pool has been elusive, but the wheels of history has been elusive, but the wheels of history have not been crushed by time. Great feats of human is still haunting eyes. Today Chinese people longing for the coveted Chinese dream can never continue to be mired in drugs.However,there are still some people travel travel on the drug road of drug trafficking and go further and further. During judicial practice, there are some controversial cases of drug trafficking problems, which need to be carefully combed in order not to cause a connection with different phenomena involved.This author is willing to contribute wisdom to work for an early settlement of disputes and difficulties of the judicial practice.This is a case study paper, which uses the method of combining practical and the oretical research.Each section is combined by the controversial case and relating issues, finally the author sorts out each dispute and problem.Full text selected practical representative dispute case to study. All of the text has about 15,000 Chinese characters,which is divided into four parts:the first part is about the definition of "trafficking".The author argues that the crime of drug trafficking don’t have a subjective premise.The second part discusses around the standard issue of drug trafficking.Although the Supreme Court’s leadership requires to accomplish the case in accordance with the decision, the author retains the views.This approach highlights the benefits, but the disadvantages can not be ignored.Therefore, I support the drug delivery point. The third part deals with accomplishment.A standard should be noted: it cannot be based solely on the quantity of drugs to identified as the perpetrator, also should consider the suspect’s role in the crime. Finally, it discusses the controversy of purchasing drug. The innovative argument is in the second and the fourth part. The author settle the case according to the theory of the criminal law.At the same time, I would like to take the fool wise to make the crime of drug trafficking more clarity.
