The Internet Fund Sales Regulation Of Legal Research

Internet fund sales rise as a new form of fund distribution, is an important supplement to our country fund sales, but our country existing law cannot fully apply the sales model of development, therefore, the corresponding regulation laws and regulations come on stage is very necessary and urgent.In order to regulate the Internet fund sales, safeguard the rights and interests of investors, this paper launches the analysis from the point of view of theoretical basis, China’s legislative status and defects, and on this basis, put forward suggestions for the Internet sale of funds to build a safe and orderly development of the environment.This paper mainly divided into three chapters, the first chapter is the general theory of Internet fund sales. Mainly introduces the concept and characteristics of Internet fund sales, reflect the Internet sales of the fund’s high yield, high flow, low threshold, improve social idle capital utilization and broaden the fund sales channels; Legal analysis on sales pattern of Internet fund, mainly to balance treasure as an example, analyses the balance of treasure of the legal nature, the main body structure,operations in the legal relationship; and further elaborated on the necessity of the legal supervision of Internet sales of the fund. The second part analyzes the current situation and existing problems of the legal supervision of Internet fund sales in China. This paper mainly introduces the China Internet fund sales status quo of legal regulation, from the existing system of legal norms and legal for two angles to launch the elaboration, and on this basis, put forward China’s Internet fund sales. The third part is the suggestions to improve the legal regulation of Internet fund sales in China, respectively, from the six aspects of the construction of laws and regulations, the main body responsibility clear, the legal status of the platform definition, internal control strengthen, information disclosure and risk management to be clear. Based on a series of theoretical and practical analysis, this paper aims to analyze the problems existing in the process of Internet fund sales in China, and then put forward some suggestions. The author believes that the Internet fund sales this innovative fund sales model will represent the future direction of development of Internet banking, with the rapid development of this sales model, only the establishment of a sound legal and regulatory mechanisms in order to achieve our financial industry healthy, orderly, diversified development.
