Research Of Introduce The Transaction Of Investigation And Debate System Into The Duty Crime Cases

Although there has no established transaction of investigation and debate system of duty crimes in Chinese criminal procedure law, there has a prototype of transaction of investigation and debate in the process of the investigation of the duty crime. This paper analyzed the meaning of the transaction of investigation and debate, and the constitute elements of it, and the relationship between the transaction of investigation and plea bargain and the transaction of investigation and debate, the transaction of investigation and plea bargain in the United States. This paper also demonstrates the theoretical basis of the transaction of investigation and debate system, and discusses the transaction of investigation and debate system in the investigation of duty crime in China to establish the necessity and possible problems. On the basis, this paper researches the transaction of investigation and debate system construction.
