The developments of information and network technique take the world into digital age, which makes copyright transaction a regime of great financial function and cultural function, with great fundamental changes to copyright transaction. With respect to copyright alteration, there are several serious problems in the rule of copyright registration and records. And there is no unified standard in judicature, courts often make contradictory judgments, which influence and restrict normal transaction. Based on the facts above, it is necessary to reconstruct the copyright alteration mode in China mainland.Firstly, in order to build the academic framework of copyright alteration, the dissertation analyze the nature and character of copyright and compare copyright assignation with copyright license. Secondly, the dissertation makes reflect on the copyright alteration legislative mode and judicial practice, and point the problem. Meanwhile based on the fact that copyright is a property right as well as the real right, the dissertation states the real right alteration mode, thus to clarify the rationality of applying real right alteration mode on copyright transfer alteration mode both theoretically and institute institutionally. At last, the dissertation concludes that we should build a basic mode of intentions and exceptional mode of formations when it comes to the copyright alteration, based on the consideration of copyright transfer’s regime function and goal in finance and culture.
