On Legal Protection Of Trade Secrets

The protection of commercial secrets is one of the most important guarantees of each company to maintain the core competitiveness, especially in the highly developed commercial technology and the modern business environment. The level of integrity to the business secret protection determines whether the enterprise to survive in the fierce competition in the market or not. The degree of the protection of commercial secrets is not only to establish and perfect the necessary foundation of market economy but also the necessary guarantee of the healthy development of market economy. It is necessary to develop the soil in China market to enhance innovation ability and innovation consciousness. At present, China’s mainland has no specialized business secret protection law, and commercial secret protection mainly focus on Anti Unfair Competition Law, which is the core of a series of laws and regulations and other judicial interpretation and etc. By contrast, Taiwan has the laws and regulations to regulate the protection of trade secrets. This paper focuses on the relevant legal system and the judicial practice, and brings out my opinions and suggestions for the protection of trade secrets in cross-strait trade between P.R.C and Taiwan after comparison and analysis.
