Research On Improvement Of Community Correction Pre-trial Investigation Work In Longcheng District Of Chaoyang

Community Correction is a new system of reform of China’s execution of punishment, to carry out the work of Community Correction, can effectively improve the quality of education and reform of criminals, to save the national execution resources, will help reduce the regulation of pressure, are conducive to enhancing social stabilities.Community correction is a reform approach of great significance for penalty system in China. As the initial procedure of community correction, pre-trial social investigation offers important evidence for judicial authority to determine whether implementing non-imprisonment penalty on criminals or not, which not only improve the accuracy of punishment determination and reduce the risk of applying community correction methods, but also is helpful to determine penalty punishment according to the individual crime case and promote penalty executive benefit. With the sound development of community correction in recent years, pre-trial social investigation has been used in judicial practice in a wider scope and various mature experiences have been accumulated. However, pre-trial social investigation has not been applied with enough highlight yet for the lack of legislation and system guarantee. The development of pre-trial social investigation system has also been remarkably restricted for the reason of lacking unification, standard, scientific guide and systematic structure in the real practice, so that investigation results have been affected in terms of justness and authority. Therefore, to build up and gradually improve pre-trial social investigation system has become a priority in the research field of criminal justice.The development and exiting problems of community correction pre-trial social investigation system in Longcheng district of Chaoyang is expounded in this thesis with the working experience of the author. By drawing on the experiences of other countries and cities in the same system, and actively explore the path of the system improved localization, proposed building "cooperation between government and society, professional survey" program and putting forward concrete Suggestions for further perfecting the scheme..I hope it will cause further consideration of legislators, scholars and officials in the real practice.
