The Research On Gambling Crime

As a kind of social and cultural phenomenon, the development of gambling has already had a profound historical and cultural background. Today, in the rapid economic development, the increasingly serious crime of gambling, the social problems caused by the growing and gradually upgrade. How to effectively combat crime has become an urgent need to solve the problem. However, because of the simplicity of gambling crime in the criminal law of our country, it makes it difficult to identify and attack the crime in the judicial practice. For this purpose, the author tries to study and analyze the difficulties and disputes in the process of judicial application based on the theory of the crime of gambling, through comparative analysis and theoretical analysis.This article from four parts, different layers of the crime of gambling in depth. The first part, the gambling crime in criminal law of our country on the evolution and development of legislation for analysis and research, clear the development and legislation process; the second part is on the foreign and Chinese gambling crime legislation for comparative study, by comparison, of domain of surgical science reasonable legislation shall be used for reference; the third part, on how to clear cognizance of gambling crime and related crimes in the judicial practice, and distinguish gambling and opening of the boundaries between the casino, introducing the case as a starting point, focus on differences and disputes were analyzed. At the same time, in view of the current online gambling in the judicial determination, the existence of the dispute of criminal jurisdiction, online games and the creation of online casinos and other issues are discussed; the fourth part, the paper points out the shortcomings in the legislation and put forward suggestions for improvement.
