Research On The Protection Of Citizen Privacy Rights In The News Communication

In the information age, the news communication industry is doing rapid development. Especially benefitted from the gradual development of the Internet, a variety of media is travelling the news to the public quickly and easily. At the same time, the situation of the news media infringing the right to privacy has become more and more serious, that has been concerned by people. How to solve the conflict between the freedom of the press and the protection of the citizen’s right to privacy to avoid the right to privacy infringed by the news, is a research subject encountered by the media and the legal profession.Based on the conflict and balance between the freedom of press and the right of privacy, this paper discusses the content and value of privacy protection, defines the connotation of the news and the concept of the news dissemination, analyses the characteristics of the right of privacy infringement in the news from three aspects: behavior subject, behavior means and damage effect from the perspective of connotation and value theory to lay the foundation to clearly the inner conflicts of the two. Secondly, on the foundation of the inner conflicts of privacy protection and freedom of the press, this paper discusses the connotation and value of the freedom of press with the topic issue of the conflict between the interests of the freedom of the press and the protection of the right of privacy and points out the essence of the conflict between the two is the contradiction between public interest and personal interest. Thirdly, this paper has a comparative study on the protection of the freedom of the press and the right of privacy in the major countries of the civil law system and the continental law system and puts forward the reference for our country. Lastly, this paper puts forward the countermeasures and suggestions for the protection of citizen’s right to privacy in the news communication in China, which contain defining the boundary of the freedom of the press to personal rights and the boundary of the right to privacy to public interest to regulate the freedom of the press; On the basis of clearing the boundaries of the two, this paper suggests to improve our country’s legal system of the news communication with the core of the news communication law which contain developing a separate news communication law, improving news communication system and constructing social responsibility evaluation system of journalism and communication; In order to make the news communication not infringing the right to privacy, this paper puts forward suggestions to perfect our country’s privacy legislation which contain defining the connotation of privacy right, improving the personal information protection legislation and establishing the system of protecting the privacy of our public figures.
