| When Litianyi who is the son of famous singers Lishuangjiang and Mengge, and other four young man,are exposed for being suspected rape case(Somebody Li Rape Case),aroused wide attention from all over the world.Seven lawyers who defended or represented for people involved in Somebody Li Rape Case are investigation by Beijing Lawyers Association (BLA),and six lawyers are given some different kinds of disciplinary the last. Somebody Li Rape Case is not a complicated criminal case, but a number of lawyers were disciplined, the public and the lawyers were both confused. Since Ministry of Justice P.R.C issued The Disciplinary Rules about The Lawyer in 1992,there are more than 20 years history of the disciplinary about lawyers,and now the lawyer punishment policy is rich in Beijing. In this paper, I choose disciplinary practices about the lawyer from 1992 to 2014 in Beijing, and for empirical research. By combing the provisions regarding punishment or disciplinary regulations for years, including the two modes of the administrative penalties and the disciplinary sanctions about the lawyer,such as the jurisdiction of the different types of punishment or disciplinary, the reasons of Being punished or disciplined, the proceedings of punishment or disciplinary,and so on. Also being analysized the practices of punishment or disciplinary about the lawyer from 1992 to 2014 in Beijing, I try to found that the trends and laws in punishment or disciplinary about the lawyer.And by investigating some typical disciplinary cases such as the disciplinary about the lawyers involved in Somebody Li Rape Case, I try to deeply understand the system of the punishment or disciplinary about the lawyer in Beijing, especially the operation mechanisms of the disciplinary about the lawyer and also the member by BLA. |
