China promulgated the "People’s Republic of China on Enterprise Bankruptcy Law" in June 1, 2007,which indicates that China has established a corporate bankruptcy system, but unfortunately, our country’s System of Personal Bankruptcy legislation has not yet set up. With the market economy development, especially in recent years China’s economy as a whole into the downstream section, accelerated debt disputes broke out, many fall into bankruptcy debtor actually.However a lot of debt can not be paid off, which not only attributable to the elimination, not a final Settlement mechanism, a “zombie debt.” Lack of natural person bankruptcy system, making the reality of a significant increase in debt settlement is not a natural person question the lack of an effective resolution mechanism. This paper argues that, in our country to build a natural person bankruptcy system is necessary and feasible, we can learn from the mature foreign legislative experience, Construction of a natural person bankruptcy system as soon as possible.This paper is structured into introduction, body, conclusion, and thanks. The second chapter analyzes the necessity and feasibility of constructing a natural person bankruptcy system.
