The "Caveat Emptor" principle is essential in financial transactions. With the boom of financial products, the demand of "Caveat Emptor" principle is increasing.However, this practice was not perfectly now. What is restricted that is the laws’ leveling and usable range.In addition,because of lacking unified standard,the related systems have a huge room for improvement.The first part of this article introduced the meaning of "Caveat Emptor" principle and it’s origin. Then,analysed the rights and obligations between related subjects. The second pargraph was introduced the "Caveat Emptor" principle in the United States and Japan,and showed their unique points.Thirdly,the article mainly expounded how the "Caveat Emptor" principle applied in China.On the one hand,it introduced the legislaion of China now,next was the history of legislation.The second topic was about the "Caveat Emptor" principle statusing in the judicial practices,then pointed what were the difficulties.As the last point, the article offered some proposal in view of the difficulties.The purpose of analysis is not to provide the financial product sellers with the blame reason, but rather in warning the importance of risk awareness to investors.The "Caveat Emptor" principle good at making the relationship between main body of the rights and obligations harmonious.In addition, the "Caveat Emptor" principle lacking systematic basis in the judicial practice.So,the other purpose to do this study is finding a solution for this problem. It can relieves the pressure of financial transaction disputes,and safeguard the healthy operation of financial markets in China...
