Research On Problems Of Urban Management Officers’ Administrative Penalty And Countermeasures

Urban administrative penalty is the important measure of normalizing city management in China, it is also the main research subject the legal scholars have been specialized for years. As we all know, in 1997, we set the first law enforcement of urban management in Xuanwu District in Beijing, in the days which followed, work of enforcement of administrative law have begun in other cities. With the gradual accomplishment of experiments in selected places, work of enforcement of administrative law have been developed effectively, after the implementation for several years, problems such as duplicate law enforcement、obscure punishment、double punishment、inflexible law enforcement were solved basically. But when facing the achievement, we should see the current deficiency clearly, with the gradual enlargement of the authority of urban management officers, there are some issues in administrative penalty of urban management officers in our country at present, its main performance is:chaotic performance of administrative penalty、lower law enforcement efficiency、law enforcement contradiction and serious law enforcement corruption. Now the trouble of urban management is caused by law system、the quality of personnel、 law-enforcing environment. If we want to change the situation, first, we should perfect legislation, restrict the administrative penalty power of law enforcement of urban management officers and make a discretion standard about administrative punishment power of urban management officer; Second, from a practical standpoint, we should improvement the relative supporting system of administrative penalty power of urban management officer; At last we should focus on personnel training, finish work of city management internally and externally, from the side out. We should solve the problem existing in administrative penalty power of urban management officer from the above aspects, so we can promote the city to develop healthily and rapidly.
