As an important issue that has a direct impact on the existence and development of human beings, global warming has attracted the attention of the international community recently. Along with the emergence of scientific evidence, global warming is not only a theoretic assumption but an issue of the existence and development of human beings. Along with the increasingly frequent international economic communication, international civil aviation industry has developed rapidly. Meanwhile, there is an increase in the greenhouse gas produced by aircraft. Now, the international community has recognized the emissions of greenhouse gas by international civil aviation industry. Both developed and developing countries have obligations to take measures to mitigate the negative effects that brought by greenhouse gas emissions of international civil aviation industry. International law plays an important part in solving of the international environmental problems. Therefore, regulation of the emissions of greenhouse gas by international civil aviation industry through international law is practical and effective. However, there is a dilemma in relation to the legal issues. That is to say, there is no thorough international legal system that deals with the emissions by international civil aviation industry. If the dilemma in the governance of the emissions by international civil aviation industry through international law can be identified, and the conflict of interests of different countries can be settled, international law can play a better part in responding to global warming.This dissertation analyses the necessity of international law in the governance of emissions by international civil aviation industry. It analyses relevant international conventions in combating climate change as well as international civil aviation conventions. The dissertation also introduces the practice of different countries in regulating the emissions of civil aviation, and aims to find a way to solve the emission problem caused by international civil aviation.The dissertation is divided into four chapters, which includes:The first chapter analyses the relationship between global warming and international civil aviation emissions. It discusses the necessity and significance of the governance of emissions by international civil aviation industry. This chapter introduces and analyses the partyof the regulation and relevant international convention in dealing with global warming.The second chapter discusses the relationship between global governance and the regulation of international civil aviation emissions by international law. It discusses the issues that need to be noticed in the solving of international civil aviation emissions from the perspective of international cooperation and the principle of "common but differentiated obligations".The third chapter introduces the 1944 Chicago Convention and the role of international civil aviation organization in the governance of emissions. It also points out the shortcomings of the Chicago Convention and international civil aviation organization in the governance of international aviation emissions.The fourth chapter proposes the possible measures that can be taken in the future in solving the emission problems. For example, reaching an international convention dealing with international civil aviation emissions specifically, emphasizing the role of soft law in the field of international civil aviation environment protection, as well as the role of sovereign States in the governance of international civil aviation emissions.
