Research On The Mechanism Of Early Intervention Of The NPC Standing Committee In The Stage Of Budgeting

After years of theoretical research and summary of the budget practice, our country has made considerable progress in the construction of the budget system.In 2014, China’s newly revised "budget law" draft was passed, the new "budget law" absorbed a lot of new achievements in academic research.Budget is the government’s overall plan to allocate financial resources in different fields and industries.The pros and cons of the budget plan directly determine whether or not to achieve the purpose of the administration.The performance and behavior of the government must be exercised in accordance with the provisions of laws and regulations, must not go beyond the limits specified relevant authority.The importance of the budget requires the establishment of the supervision mechanism of the government budget behavior.Aspects of budgeting is the core link of government budget behavior and the preparation of the draft budget to enrich the theory and data as the basis, and the budget session also need to the supervision of the National People’s Congress to ensure the scientific nature and the rationality of the draft budget.Therefore, the establishment of the NPC Standing Committee in the preparation stage of the early intervention mechanism is very necessary.The early intervention mechanism of the NPC Standing Committee is an important part of the NPC Budget Supervision System. Firstly, the author discusses the connotation of the early intervention mechanism, and then analyzes that in the early intervention mechanism, the nature of the NPC Standing Committee’s authority is the right of supervision, and it is the embodiment of the National People’s Congress in the budget preparation stage.The supervision right of the early intervention mechanism is closely related to the other stages of the budget process.The law clearly stipulates that the budget is the power of the government,so whether the Standing Committee of the early intervention will affect the independence of the government budget for the preparation of the right?Through the analysis, the author believes that the conflict between the two will not appear.The establishment of early intervention mechanism can bring a series of benefits. To establish the mechanism of the early intervention can improve the budgeting of scientific and reasonable, can promote the perfection of China’s National People’s Congress supervision system; perfect budget responsibility system of our country, reflecting the requirements of establishing a modern public budget.From the early intervention mechanism of legal principle basis, legal basis and a series of elements of the argument, it is proved that the establishment of this mechanism is very feasible.At this stage, the law does not clearly define the early intervention mechanism of the Standing Committee of the people’s Congress,however, in practice, there are a lot of local people’s Congress Standing Committee to promote the establishment of early intervention mechanism.These experiments provide researchers with a wealth of research material.By analyzing the practice of early intervention mechanism in the present stage,to reflect on the experience of these practices for reference,to avoid the mistakes,and to explore the cause of the crux of the problem.Due to the lack of theoretical research and the lack of practice, the problems in the construction of the early intervention mechanism is inevitable, but it is necessary to analyze these practices in order to explore the feasibility of higher operating mode.At present, the practice of some local people’s Congress Standing Committee is carried out in the absence of a clear legal provisions,and theoretical circles pay less attention to early intervention mechanism.First of all, the author analyzes the theoretical basis of early intervention mechanism, then analyzes the framework of early intervention mechanism, studies the elements of early intervention mechanism, and finally finds out the operation mode of early intervention mechanism. Finally, the mechanism is constructed by establishing the effectiveness evaluation criteria of early intervention mechanism.
