As one kind of preemptive right, the preemptive right of lessees is an important legal system in our country. In our country, the right of preemption of the lessee is limited to the priority purchase right of the house tenant. In nature, the right is the right of formation. The lessee’s right of preemption is established in the house lease contract effective date. Only when the house is sold by the lessor, the lessee can exercise this right. Supreme People’s Court promulgated the "on the trial of urban housing lease contract dispute cases of specific application of the law to explain a number of issues," in which the lessee the right to purchase the right to make further explanation. The exercise of the right of preemption of lessee’s concept, nature and rights are analyzed, and then expounds the rights remedy human rights violations after justice.
