The situation of the primary stage of socialism and current situation of rapid economic development lead to a lot of problems, and the wrangles over minerals between the central authorities and the local government have been published frequently. However, all above, most of the time, are resolved by administrative means, the essential contradiction isn’t solved yet. The pattern of ‘State Ownership’, which is stipulated by the Constitution, has led the ownership subject of minerals virtual. That’s why the clear system of property rights on minerals is not set up now. So building a modern system of property rights on minerals, which has clear property rights and a fluent circulation, is urgently in order, in the situation of the primary stage of socialism, while to achieve this goal it is necessary to ensure that in the case of the central authorities took the national title, and look for more ways to local government in the exercise of property rights on minerals.This article is based on the Marxist political economy, and focuses on sorting on the Marxist ownership system, the government theory of Marx and Engels, and the Marxist property right system. By analyzing the advanced experience and the shortages on the foreign local system of real rights, we will get many substantial references for refining our real right for minerals and building our local system of real rights. In a complete mineral property rights system was established, local governments actively involved in mineral property rights exercise will help maintain the economic basis of public ownership, to rationalize the relationship between central and local, to promote environmental protection and experience of socialist construction.
