Research On The Construction And Improvement Of The Power List

The power list system is an important legal system which can promote the administrative reform. Furthermore, the power list system aims at standardizing and regulating the administrative power. From the perspective of law, the power list is a legally binding text regulated by the right subject related to the contents, types, numbers, running program and the scope of exertion of administrative power through certain legal procedure. Meanwhile, the power list is regarded as a normative legal document. The significance and purpose of running the power list are to determination of administrative power boundaries, make the power clear, strengthen community supervision, construct the government ruled by law, and advance the healthy growth of the market.Currently, the power list has achieved great effect, such as, it does clarifies governmental authority by determining power boundary, simplifying power issues, promoting service efficiency, increasing the reform dividend, and opening the power procedure with less discretion, while more governmental responsibility. However, the power list just carried out for a rather short time, and lack of theory research, so that there are some problems in the running process. The main problems are:(1) The inaccurate reservation of power list, it causes ambiguous goals of power list;(2) The lack of tracing responsibility system, resulted in the imbalance between power and responsibility, finally the power will be abused.(3) The non-uniform of the contents and classification standards for the power list, which make the original simple power list hard to be understood;(4) The administrative simplification is treated equally with the power list, which just seems like cutting powers aimless;(5) The shortage of power running process, it leads to the ignorance for the way, time, sequence, and steps of exercising the powers;(6) The irregular of power platform operation and the deficiency of the platform operation skills, which caused it hard to guarantee ones open their powers.According to research, some solution should be carried out to construct industriously the requirement of validity of the power list. For example, one solution is to determine the planning subjects of the power list and related program composition, and the related contents. Meanwhile, the formulation of the power list should be followed up, and gradually achieve the power equal to responsibility. The other solution is the contents of the power list should be classified uniformly according to the existing power matter, and strength the top design. Otherwise, the supervision mechanism of power list should be improved, and enhance the supervision at present and after the event, especially the social supervision. Finally, to build a network support for establishing the government information sharing system and build the program flowchart for clarifying the process of power operation. Only by a dynamic power list, the construction of power list can be permanent and ever-lasting.
