Study On Crime Of Collusion Bidding In Engineering Contribution Projects

As a kind of way to sign contract, bidding is widely adopted in areas such as the international engineering contracting, purchasing and supply of complete sets of equipment and large equipment, major national scientific research project and real estate industry and etc. It’s transaction approach which is highly competitive. Bidding has a long history in commodity economy which means to make social resources effective use and then to make fair, reasonable, effective and fast development of market economy. So bidding behavior should follow the principles of openness, fairness, justice and honesty. With the rapid development of social economy, the bidding in the construction industry areas is facing increasingly fierce competition, which brings several of problems. Under the profit-driven, in order to make most interests, many companies submit tenders in collusion with one another in biddings. When the bidders reject others competitors through collusion by unfair means, the bidding behaviors will lose their function, and so as to do harm to the whole nation and other bidders and disturb the normal market order.So to maximize the interests of law-abiding party, we need to research on this illegal conduct in a legal perspective and make the bidding behavior become more legal and put it in the sun. This paper firstly researches on the basic theory of bidding system and analyzes the collusive bidding status. Meanwhile, the paper makes a deep analysis of the nature of the bidding collusion from the perspectives of economics and law, and analyses the causes of bidding collusion, such as rule defects, poor supervising etc. Finally, this paper establishes the countermeasures in detail to the bidding collusion behaviors. Through the comprehensive analysis, more scientific approaches to contain collusive bidding behavior in construction engineering field are expected to be established.
