The Research Of Visitation Rights

Since the reform and opening up, more and more women have been entered the workforce, the economic dependence on men is weakened, and the people’s love and marriage relationship is more independent. With the rising divorce rate in recent years, there are numerous visitation disputes. Although the 2001 Marriage Law of visitation right of our country has been incorporated into the system of marriage law,but in judicial practice, the dispute resolution is not satisfactory arrangement. Visiting subject scope is too narrow so that parents visitation right can not be fully satisfied and implementation of visiting is not enough leading to the difficulty of law application and so on.There is a series of problems are placed right in front of the legal workers. The author will try to discuss these issues in the following section, and provide legislative proposals.This article is divided into three parts. The first part is an overview of the visitation right, the author will explain legal provision of our country and analysis concept of visitation right.Introducing the development course of visitation right both in China and abroad. In the second part, author will do comparative analysis between the foreign visitation right system and the system of domestic visitation right. The domestic visitation system deficiencies can be identified by the method of contrast analysis on one hand; on the other hand, the good aspects of foreign visitation right system can be used for reference. The third part will put forward better suggestions for current visitation system of our country,and the third part is also the key part of the article. In this part,the author will analyze six part of visitation right include the purpose of the visitation right, the subject of visitation right, content of visitation right, execution of visitation right the and visitation right dispute.
