Research On German Consumer Group Litigation

In recent years, China’s economic has been rapidly developing, but with the consumer boom happened also in China all types of damages to the interests of consumers. China’s newly revised "Civil Procedure Law" and "Consumer Protection Law" created the first "Chinese Consumer Public Interest Litigation" system. The combination of the two newly revised laws have brought new opportunities for the solution of problem. But with only two principally provisions is not enough. Germany consumer group litigation has a very important reference for the development of Chinese consumer public interest litigation.This article comprises five parts as follows:The forewords introduce the background of the consumer problems in China and Germany.Chapter one analyzes the historic development of German consumer group litigation system, including legislator’s conception of the German consumer group litigation system.Chapter two focuses on the main content and provisions of the German consumer group litigation and analyzes its practical problems.Chapter three analyzes the legal practice of German consumer group litigation, as well as the historical particularity of Chinese public interest litigation system. And the last part from the perspective of comparative law focuses on the reference and importance of German consumer group litigation to Chinese consumer public interest litigation.The conclusion summarizes the key viewpoints in this article.
