Research On The Mechanism Of Rapid Adjudicationof Minor Criminal Cases

Our country has not established a set of complete misdemeanor system at present, processing of minor criminal cases lack of the special regime of legal to support and the guide. If all cases adopt for the procedure of Criminal Procedural Law, it is unable to meet the demand that the minor criminal cases can be handled rapidly, it also reduces judicial efficiency and wastes judicial resources. Therefore,the first priority in dealing with criminal cases in our country is to explore a set of judicial proceedings conforming to the minor criminal cases, the minor criminal cases should be handled rapidly on the base of guaranteeing rights, so we can optimize judicial resources disposition effectively.In 2014, relevant rules has been published,it is definite that pilot cities would be determined to execute the mechanism of rapid adjudication of minor criminal cases, complex and simple cases would be classified, related procedure would be simplified, and corresponding steps would be reduced in court trial.I think that the judicial organizations should explore the mechanism of rapid adjudication of minor criminal cases that is suitable for the situation of China and feasible,which is on the basis of respecting the parties’right of election and combine foreign legislation and judicature.This article stands on our present national conditions,it put forward some specific advice and suggestions aiming at how to establish quick judging procedure of minor criminal cases in our country,which was based on analyzing current system to build quick judging procedure of minor criminal cases.This paper introduce the concept of quick judging procedure of minor criminal cases in our country, its boundary with other cases, and its characteristic. This article displays current implementation situation of quick judging procedure of minor criminal cases, enumerates law system of foreign relevant procedure and draws some experience from foreign relevant procedure according to the characteristic of quick judging procedure in our country, Aiming at the deficiency at present,I offer some recommendations on quick judging procedures of minor criminal cases in our country,I hope that this article will be able provide reference to judicial practice now as well as the improvement in the future.
