Empirical Analysis On Discretion Standard Of Administrativepunishment Of Road Transport In Inner Mongolia

Discretion power of administrative punishment of road transport is the core of administrative power of road transport, in the process of the punishment for the illegal activity in this field,if there is no clear standard, it can easily lead to arbitrary direction even abuse of the administrative organ of road transport.Discretion standard of administrative punishment of road transport, worked as one of the effective method to control the right in administrative punishment of road transport, is especially important.This paper combs the concepts of discretion standard of administrative、discretion standard of administrative of road transport in detail, I mainly analyzed discretion standard of administrative punishment of road transport in Inner Mongolia aiming at main norms、 main principles、main contents, which is on the basis of discretion standard of administrative punishment in the field of road transport in our country.Next,I introduced the existing problems of discretion standard of administrative punishment of road transport in Inner Mongolia and analyzed the reasons that caused the problem. In the end, I proposed countermeasures to perfect discretion standard of administrative of road transport in Inner Mongolia aiming at the reasons caused the problems, the countermeasures mainly include four aspects:defining the bodies of standard-setting、regulating the legislative techniques,increasing public participation and intensifying supervision, I hope I can provide some reference for the discretion standard of administrative punishment of road transport in the future.
