Study Of The Rapid Adjudication Of The Cases Concerning Private Lending

With the effects of various economic elements home and abroad, the cases derived from private lending has come out in an unending flow and the cases accepted by the people’s court all over the country have been increasing strikingly, which leads to the problems, such as the difficulty of service, taking evidence, and enforcement. Therefore, it is very important to set up a scientific and reasonable mode of hearing the cases concerning private lending. With simple facts and single legal relationship, the cases concerning private lending are usually heard with the mode of rapid adjudication for saving the parties’time and raising the court’s efficiency of hearing cases. With the sudden emergence of the hearing mode of rapid adjudication, the challenge from the high rate of accepting the cases concerning private lending has been greatly relieved. However, there are still a lot of problems existing in the application of the system of rapid adjudication of the cases concerning private lending in spite of the revision and supplement of relevant laws and rules, judicial interpretations and the judicial reform undertaken by the people’s court. These problems not only affect the performance of the function of the entire system of civil litigation, but also decrease the judicial credibility and enhance the intensification of social contradictions. Thus, it is very necessary to make research in this aspect. The thesis introduces the cases concerning private lending and the system of rapid adjudication of the cases. Based on the introduction, the current legislation, the adjudication, the major problems and the causes of the system of rapid adjudication of the cases concerning private lending in our country are completely analyzed. Finally, the specific suggestions on improving the system of rapid adjudication of the cases concerning private lending are put forward so as to provide means for improving the system in our country.
