| The phenomenon of "Screwing Send Lawyer" is a hot topic in criminal judicial field in recent years, it is a stage product in the current judicial environment. Research the phenomenon of "Screwing Send Lawyer", will help us find the problems in the process of constructing "China ruled by law", by solving these problems will help us to achieve "China ruled by law" as soon as possible.The main body of this paper is divided into three parts. In the first part, firstly, recalling typical cases which along with the emergence of "Screwing Send Lawyer" to explore the evolution of "Screwing Send Lawyer" phenomenon. Secondly, this part makes a category analysis on "Screwing Send Lawyer", it is divided into "False Screwing Send Lawyer", "Similar Screwing Send Lawyer" and "True Screwing Send Lawyer" categories, this paper mainly researches the "True Screwing Send Lawyer" category. In the second part, the author analyzes the reasons for the emergence of the phenomenon of "Screwing Send Lawyer" from three aspects of "The influence of Chinese traditional litigation culture", "The imperfection of judicial systems and mechanisms" and "The lack of effective protection of the litigation rights of the defense lawyers", in this part, the author combines some defending opinions of the Guangxi "Beihai case" and related materials that I gathered. Finally, the strategies of "Strengthen the concept of procedural justice", "Improve the judicial systems and mechanisms ", "To guarantee the effective exercise of the right of defense lawyer" and "Strengthen the ability of defense lawyers to defend effectively" are proposed. |
