The Study On The Legal Issues Of Private Equity Fund In China

In recent years, as capital market becomes increasingly active, the private equity fund industry has entered into a stage of rapid development in China. However, for a long time, the management ideology that attaches importance to public offering and despises private offering in financial markets of China causes many blank spaces in legal regulation of current legal system regarding private equity fund. In fact, the imperfection of the legal system results in much chaos in private equity fund industry, which continuously for a long time will inevitably hinder the benign development of private equity fund. Therefore, it has become the top priority in the development process of private equity fund that how to establish and perfect the legal system of the private equity fund in our country. Accordingly, this paper analyzes the full range of private equity fund from the five aspects of basic concept, organization forms, supervision system, exit mechanism and some controversial legal issues in practice. Moreover, this paper puts forward some specific suggestions aiming at improving China’s legal system of private equity fund, in order to better promote the healthy and rapid development of private equity fund industry in China.
