The related research system of judicial division starts earlier, in the end of 1990s and early scholars have published works on this problem are discussed, but most of them are to be mentioned in this inquiry occasionally the framework of the reform of the judicial system, aiming at the problem of no further special elaboration, has not made clear "judicial divisions" concept. Most of the related studies remain in the "jurisdiction", "judicial jurisdiction system" within the framework. With the eighteen third fourth plenary session, held a victory of judicial divisions became increasingly prosperous, and the path of reform has also been defined as cross administrative divisions of the court and the procuratorate, but a clear direction is only the first step of reform and how to realize the cross administrative law review is needed for the specific operating guidelines.Based on the concept analysis of the judicial division, set up the court of our country and its status quo provided legal basis, through the selection of the current domestic court cross administrative divisions of exploration as the research sample, using empirical analysis, summed up the province directly under the county (county-level city) type Hanjiang, Jiyuan mode, city town tube type Dongguan, Zhongshan and Beijing is relying on the special court, three judicial divisions of Shanghai mode change. The specific factors of the judicial division reform needs to consider, summary should follow the standards and principles of inductive reform, and the experience and the lack of the final finishing. On this basis, combined with China’s national conditions, intention explore a step by step, judicial division reform road. Seek steady change.
