The death penalty is a widely concern and controversy. Caused a lot of attention from the Beccaria suggested abolished the death penalty has been more than 200 years, but whether abolishing the death penalty still is the focus of the debate. And on the natural rights theory to discuss the death penalty is a focal point of the death penalty controversy, is a huge controversy. Although after Hume, bentham criticizing, natural right has been the glory of the past, but its value has not been completely refute, also cannot be thoroughly refuted. As a kind of to protect the rights of people at the core of the oriented theory, from the natural rights theory to discuss the death penalty has its value. At the same time, the question of the death penalty for the theory of natural rights is extremely important and necessary. We can see that the death penalty against people’s right to life at the same time to protect the rights of natural has its unique role, whether death penalty should be abolished, the theory of natural rights should have the answer. However, both sides of save or abolish death penalty can find the basis of their argument from the natural rights theory. This paper discusses natural right theory, analyzes the attitude towards the death penalty.This paper can be divided into three parts:The first part discusses the arguments on both sides to save abolish death penalty and the basis and practical considerations in the theory of natural rights, and analyzes the value and the contradiction between each other, and finally analysis of Locke and Rousseau solution of contradiction and questions.The second part, from analysis of the natural right theory, the natural right theory of absolute is needed, and how compatible with natural rights, and this phase will not affect the foundations of the rights of nature itself and distinguish with utilitarianism.The third part in the second part, on the basis of theory of natural rights is compatible with the death penalty. The death penalty is a kind of what kind of a system, it is how to run, analysis of the death penalty is justified in the theory of natural rights, and is especially concerned about the death penalty misjudgment.
