| As an important part of the system of rewards and penalties in performance examination for prisons, administrative punishment in prison management refers to necessary punishments or enforcement measures on prisoners who had violated the supervising and managing order. Through the investigation of the practical operation of the administrative punishment system of the prison in our district, we can find that systematic and normative laws and regulations are missing in the application of administrative punishment in prison. Certain special rights existed in practice. The legal reservation and judicial review are excluded, and there is no guarantee of due procedure. Above abuses have great impact on prison justice, impartial law-enforcement and right protection for the prisoners. Therefore, it’s extremely important to explore a way to perfect the administrative punishment system in prison management.Based on the realities in current prison management system, and combing the practical experience of the author in grassroots unit of the prison, this paper, with methodologies such as investigation, comparative and empirical analysis, objectively analyzes and evaluates the administrative punishment system in prison management, and presents practical and reformational suggestions on perfection of administrative punishment system in prison management.Start from the definition of administrative punishment, this paper learns the connotations and extensions of administrative punishment in prison management, and selectively analyzes the legal nexus of administrative punishment of prison management. Then based on the prison in our district, the practical problems in administrative punishment in prison management have been comprehensively analyzed and summed up. As the key points of this paper, according reform suggestions and countermeasures have been proposed in detail. This paper also analyzes the remedy mechanism for administrative punishment in prison management. Except remedies such as state and administrative review inside the prison, this paper also suggests limited judicial review, and explores the way to establish supervision and inspection tour mechanism involving public interest lawyers.Through systematically and comprehensively review of administrative punishment system in prison management, and analysis of the existing problems and shortcomings in current administrative punishment system in prison management in our district, this paper intends to explore countermeasures and suggestions for further perfection of administrative punishment system in prison management, thus to provide a direction for establishing and perfecting the human right protection system for the prisoners, as well as a reference for perfecting the regulations of administrative punishment system in prison management in our district, and guide the practices of front-line policemen in prison. Perfecting and improving prison management system and administrative level will contribute to the construction of law-governed prison, as well as the social fairness and justice. |
