The Modern Trend Of Legal Rhetoric In China’s Context

The research of the legal argumentation is on the rise in China,many of the emerging theoretical studies stuck “China situation”label.Legal rhetoric appearing under this background.Due to the legal rhetoric theoretical system has not been constructed in China,the use of legal rhetoric have some problems.But we must square up to these problems and solve them.What we should do are to dilute the awareness of dispute resolution,to make legal rhetoric playing an active role on the verdict and to enhance people’s rule consciousness,when we face up with legal rhetoric’s function tends to conceal an improper purpose. What’s more,we need universal concept about rhetoric,such as rhetoric subject,rhetoric object and rhetoric receptor. We also need improve the ability of legal community about rhetoric,when we face the situation that wrong rhetoric method influence the effective of dispute resolution.Besides,we can also consider improving the legal rhetoric from outside,and combining the legal principle and legal rhetoric is a way to lead value judgment into judicial activities.
