Study On The Solution Of Conflicts Of Administrative Law Rules

A new round of electric power system reform is the important action of electric power field in implementing the spirits of the Third and Fifth Plenary Sessions of the 18th Central Committee of CPC. In addition, it is the important component of comprehensive reform deepening in China. One of the key points of electric power system reform is to accelerate the construction of market structure and market system with effective competitions, and form market-oriented electricity tariff mechanism. As the current electricity tariff management in China is mainly based on government pricing, electricity tariff adjustment often lags behind cost changes and legislative amendments, thus it is difficult to timely and rationally reflect real market supply and demand conditions, impeding the further development of reform.Basing on the true case of certain law office, and taking the conflicts of two-part electricity tariff documents as perspective and electricity tariff reform in electric power system reform as breakthrough point, this paper tried to conduct corresponding elaboration and demonstration on legal issues possibly involved in case. Moreover, basing on attempting to resolve the focus of dispute, it summarized the legal issues exposed in electricity tariff reform, and proposed corresponding solution thought, hoping to provide help to the reform and development of electric power industry.This paper is composed by three parts. Part I presented the current electricity tariff reform in China and drew forth problems, mainly introducing case background and summarizing the focus of dispute. Part Ⅱ conducted analysis on case and prepositive problems, and tried to present relatively explicit conclusions. In addition, basing on trying to resolve the focus of dispute, it carried out summarization and integration on involved basic theory of administrative laws and applied it into practice. Part Ⅲ is the thinking extension, which analyzed a series of derivative problems existing in administrative law rules in China’s technology field, and endeavored to propose corresponding solution and improvement measures.
