Research On The Legal Protection Of The Patent Law Of The Graphic User Interface Design

The patent protection of the graphic user interface design in China in 2014, which to our country electronic information industry is a thing which is worth celebrating. This reflects our country industry innovation ability has improved significantly. On the other hand also reflect the degree of attention on the protection of intellectual property rights of our country continues to improve. But due to the influence of the traditional design concept of the system, the graphical user interface design patent protection is cautious and conservative attitude, only part of the general provisions, no detailed specification, which leads to this kind of innovation design in rights and infringement appeared some problems, if these problems are not resolved in a timely manner, a graphical user interface design will not be able to really protect applicant innovative design.Therefore, this paper will focus on the conservation status of a graphical user interface design, analysis of some of the problems, and through the national and foreign mature protection of the graphical user interface compared to search for the related practice of reference, thus for future laws and regulations repair order to provide advice.This paper is divided into four chapters, first chapter through the analysis of the constitution of the graphical user interface, pointing out its suitable appearance design patent protection, and according to our country the appearance design patent protection system, the graphical user interface designs to protect the status quo.In the second chapter, the author analyzes the problems in the determination of authorization and infringement by detailed analysis of the patent for the design of graphical user interface, and analyzes the shortcomings of the present system in China.In the third chapter, we will introduce the foreign graphic user interface design system, look for the experience that can be used for reference.In the fourth chapter, we put forward some suggestions for the modification of the design system of the graphical user interface in our country, aiming at the problems of the previous analysis and the foreign experience.
