Study Of The Violence Tort Of Amateur Sports

Along with the vigorous development of modern sports,the violence tort in amateur sports is intensified.Because of the particularity of such infringement itself which is different with general tort, this paper firstly analyzes its features,and then explores the legal problems and cause of amateur sports violence, and gives the corresponding solution.The violence tort in amateur sports has five characteristics,such as hard to determine the subjective intention of violators the behavior’s violence and regularity、 tort results with serious personal injury、 the subjects’s non-professional nature and the varied tort liability subject.lt is the five characteristics that distinguish the violence tort in the amateur sports from the general tort,and make it possess the research value and significance.There are three main legal problems in the amateur sports violence tort:the improper application of liability principle、the application of the assumption of risk existing defects and the controversy of the main responsibility. Through analyzing the cause of the three legal problems, this paper puts forward to perfect the judgement of the tort liability and make the definition of legal responsibility subject more reasonable in order to slove the problems.At the same time,we also need the insurance system to compensate for the damages of such tort.
