Analysis Of Reviewing Standard On Business Method Patent Eligibility

It has been highly concerned by American legal professions whether business method can be patent eligible. The standard to review a patent has also been through up and down. From the beginning of exception, then entirely open the gate, then improve the standard. In June 2014, the U.S. Supreme Court issued a decision in Alice, in which they gradually build up an interim framework to review a business patent eligibility. We could see the opinion and direction the court made on this issue. This note bases on the judgement of Alice and other cases, look back on the background of patentability. It goes through the court decision and explores the impact of these cases.We should benefit from American recent cases in our revising Patent Law, and learn more experiences of reviewing practice. We have to set up our own standard of business patent eligibility to improve our patent quality.
