Administrative Law Analysis Of College Students’ Violation Of Examination Regulations

It is an important part of the daily management of the universities to deal with college students’ violation of examination regulations. But the law governess on the treatment of examination irregularities is still not perfect in the colleges of our country especially lacking of the clear rules in some important ways such as the procedure and the relief of the treatment of examination violation behavior among college students. Dealing with violation of examination regulations in college has no unified rules to follow lead to different results and the various irregularities processing. What we can foresee is that students and college administrators are confused about what to do when examination violation occurred.With the improving of the college students’ legal consciousness, the administrative cases caused by students’ dissatisfaction with universities’ way to deal with examination irregularities are more and more. But due to the controversial theory, sometimes the judge will also make the completely opposite judgment in the same kind of cases. All of these situations inspired the author to write the paper from the perspective of administrative law to provide the thinking and find out how to effectively deal with college students’ violation of examination regulations.There are five chapters in this paper totally. The first chapter elaborates on the basic concept of the treatment of college students’ violation of examination regulations and points out three important principles of college students’ examination irregularities processing.The second chapter elaborates on some controversial problems such as the position of university when it deal with the students who violated the examination regulations and the relationship between the colleges and students in the processing from the theoretical level.In the third chapter the author firstly analyzes two administrative cases related to college students’ violation of examination regulations which one is expulsion case and another is cancelling the degree case because of cheating in examination. And then try to construct the entity legal system about the treatment of college students’ violation of examination regulations.In the fourth chapter, the author firstly compares two administrative cases related to college students’ violation of examination regulations which are both caused by illegal and unreasonable procedures. And then try to construct the procedure legal system about the treatment of college students’ violation of examination regulations.The last chapter put forward some suggestions from the three levels of campus appeal, administrative reconsideration and administrative litigation to help students to protect their own rights.
