Between Individual Rights And The Community Good

In order to solve some problems in the field of China’s current justice, such as individual rights protected,and a decrease of judicial credibility,this paper is committed to provide the corresponding theory of law philosophy.The paper mainly divided into three parts:in the first part, the paper expounds the relevant problems of the right and good by the typical judicial cases and analyses the concept of natural right and the right idea of the current society in our country.The second part emphatically elaborates the legal philosophical debate of the right and good,and focus on the discussion of Rawls’ s concept of right and Sandel’s concept of community.The third part tries to reconcile Rawls’ s concept of right and Sandel’s concept of community by analysing the traditional and current social structure of our country and provides the corresponding theory of law philosophy for solving some problems in judicial practice by appealing to improve the public rational consciousness and increase the citizen participation of public life.
