Gender Perspective Of Domestic Violence Legal Governance In Our Country

With the local regulations and related policies of anti-domestic violence published one after another,our country’s anti-domestic violence law published on December 27,2015 and come into force on March 1,2016.It means the our country’s research of against domestic violence into a new stage.The author in the perspective of gender,analyze the anti-domestic violence law in our country based on the our country’s national conditions,then give some suggestions to improve and perfect it by method of comparative analysis.The suggestions are based on the successful experiences from foreign country and other region in China.The introduction part provides a brief overview of anti-domestic violence legislation of foreign country and review the anti-domestic violence legislative process in our country.Then introduce the significance of the subject,research methods and innovations in this paper.The first part author define the concept of domestic violence in our country’s anti-domestic violence law from the perspectives of the subject and actions by compare the law at home and abroad. Then,analyze the causes of domestic violence,and point out that lack of legal governance is the immediate cause of domestic violence,and the unequal gender relationship is the primary cause.Finally,analyze the damage of domestic violence.The second part introduce the origin and development of gender theory.Then.analyze the significance of gender theory.Finally,introduce the advantages of in the perspective of gender analyze domestic violence legal governance in our country.The third part in the perspective of gender analyze the deficiency of the anti-domestic violence law in our country from the perspectives of evidence rules,habeas corpus and the disposition of domestic violence,in order to give some suggestions to improve and perfect the anti-domestic violence law in our country.The fourth part introduce and compare the characteristic and successful experience of domestic violence legal governance in Britain,America and TaiWan.The fifth part according to the deficiency of the anti-domestic violence law in our country from the third part and the successful experience of domestic violence legal governance at home and abroad,give some suggestions to improve and perfect the anti-domestic violence law in our country from the perspectives of evidence rules,habeas corpus and the disposition of domestic violence.
