Research On The Settlement Mechanism Of International Investment Disputes From The Perspective Of The "One Belt One Road" Initiative

The "One Belt One Road" Initiative is a great project for the benefit of all the countries along that area. With the powerful impetus of China, it will undoubtedly inject new impetus to the further prosperity of the world economy. The comparatively perfect settlement mechanism of investment disputes, is often an essential condition of regional economic cooperation to promote smoothly. Countries in the "One Belt One Road" area have different national conditions, and the situation is complicated. There is great possibility of transnational investment disputes to occur, so the settlement mechanism of investment disputes in that area is the problem that we should focus on to analyze. Just like other regional economic cooperation organizations, what regional characteristics the investment disputes under the "One Belt One Road" have, how to solve these disputes, and how to construct the settlement mechanism of international investment disputes under the "One Belt One Road" from the aspect of law, is the focus of attention from all walks of life. For the problem, this thesis provides a comparative analysis of the current settlement of investment disputes in China from angles of text of the treaty and the practice situation, combined with some typical settlement mechanism of investment disputes in the world, and then puts forward settlement mechanism of disputes from the perspective of the "One Belt One Road" initiative. According to this train of thought, based on the study of some settlement mechanism of investment disputes such as ICSID, NAFTA, the author discusses the legal framework of the comprehensive settlement mechanism of international investment disputes from the perspective of the "One Belt One Road" initiative, from aspects of BIT, MIT, establishment of specific settlement organization of disputes, and improvement of domestic law.
