Legal Issues On Chinese Judgment Online

Court judgement is the final result of a judicial process that determines rights and duties of the relevant party. Online availability of court judgement not only contributes to the development of judicial transparency, but is also a basic requirement in modern courts. According to the Judicial Opinions of China website which makes court judgment available to the public, this has only been recently established, has issues to be resolved, and can be developed according to the ideal. Therefore, it is essential to conduct further systematic studies to understand the value and significance of online court judgments, as well as study on other countries with a more developed platform (i.e., United States).In this regard, this paper is divided into 4 chapters. Part 1 introduces the significance of the online availability of court judgments and the current circumstances in China and the United States, its background and foundations. Part 2 discusses about the differences between China and the United States with regard the scope of the online availability of court judgments. First and foremost, I utilize the online transparency of relevant documents and court records to introduce how the United States maximizes its platform. In addition, I conduct a research on the amount of time the courts of the two countries take to upload the papers, as well as the legal obstacle that affects the timeliness of the upload in China. I also conduct a comparative analysis on the frequency (annual,1999-2015) of their total uploads. Part 3 discusses about privacy protection on both platforms, focusing on the scope of protection and the duty of the party on this matter. The benefits of the use of computer technology in the United States of America in this regard are also tackled. Part 4 is an examination of the quality of court judgements available online on both platforms.This paper uses practical, experimental, and empirical methods as its main research methods to analyze the Chinese online platform for judicative papers. This study includes an analysis of judicative paper upload time and duration, as well as an examination of personal privacy protection, protection method and the accuracy of online judicative papers.
